Sen. Ted Cruz (R-TX) is in a heated race to hold onto his seat for a third term as the polls show him essentially tied with his Democratic challenger, Rep. Colin Allred.
Cruz, who announced his candidacy almost immediately after introducing a bill to limit Congressional terms, infamously used an image of Manhattan District Attorney Alvin Bragg in place of Allred's in a fundraising text.
So it's unsurprisingly to learn that not only has the Cruz campaign released a series of attack ads against his opponent, but that they've once again made a glaring photo gaffe that could lead to a lawsuit if they don't pull it.
An Oregon school district sent a letter to Cruz’s campaign last week asking them to pull two ads targeting transgender athletes because they both include a photograph of two minor girls who are not transgender and whose parents did not give the Cruz campaign permission to use the photo.
The Beaverton School District's letter asked the Cruz campaign to pull the ad from all social media and other platforms immediately.
"The two athletes pictured are minors; the one on the left in the Westview hoodie is our student. Neither the family nor the school or school district ever gave permission for this photo to be used," the letter said. "In addition, the ad implies that at least one of the athletes in this photo is transgender. Please know that both of these athletes were born female and identify as female; they are not transgendered."
The district also criticized the campaign for promoting the ad with false information, "especially with minor children involved."
