One of the main points that Democrats have made as to why Brett Kavanaugh should not be confirmed to the U.S. Supreme Court, is their belief that he would try to overturn the landmark case, Roe v. Wade.
Many Republicans have argued that this is not the case, and that Kavanaugh would respect the previous decision by the U.S. courts. Now, however, an email has leaked that seems to put Kavanaugh’s opinion on the matter in a totally new light.
The email from Brett Kavanaugh to James Ho and Barbara Ledeen, on March 24, 2003 includes the excerpt that reads, “I am not sure that all legal scholars refer to Roe as the settled law of the land at the Supreme Court level since Court can always overrule its precedent, and three current Justices on the Court would do so. The point there is in the inferior court point. ”
This could be a huge roadblock in the Kavanaugh confirmation. Stay tuned!
