Army JAG Vindman Volunteers To Court-Martial “Comrade Flynn”

Army Lt. Col. Yevgeny “Eugene” Vindman has offered to court-martial former Lt. Gen. Michael Flynn for his comments that appear support a Myanmar-style military coup against President Joe Biden and the “reinstatement” of Donald Trump to the presidency.

Veygeny and his twin brother, Alexander, both were fired from National Security Council posts by Trump following Alexander’s bombshell testimony at Trump’s first House impeachment hearing in 2019. Alexander retired from the military not long after, but Eugene was promoted by the Army to his current position in March. Eugene is a member of the Judge Advocate Generals Corps, the legal arm of the Army that comprises serving officers.

On Monday he tweeted his thoughts about Flynn’s comments at last weekend’s QAnon conference in which Trump’s former national security adviser in which he said, “No reason. I mean, it should happen here. No reason. That’s right,” in response to an audience question about why a military coup like what took place in Myanmar could not happen in the United States. Vindman called his response sedition.

“With these seditious remarks Comrade Flynn may have crossed the line for recall to active duty and court-martial,” Vindman said on Twitter on Monday. “As a JAG I’m qualified and also happy to prosecute this case.”

Stephen Vladeck, an expert in national-security law at the University of Texas School of Law, said on Twitter that while Flynn is a retired Army officer, he’s still subject to the Uniform Code of Military Justice.

“The constitutionality of jurisdiction over retirees for post-retirement offenses is something we’re currently challenging in the Court of Appeals for the Armed Forces & the D.C. Circuit,” Vladeck said.

As is standard operating practice for Trumpsters, Flynn later denied that he had called for a coup.
